Safehouse:  Could Philadelphia be the First State in the Nation to Implement a Supervised Drug Injection Site?"},"content":{"rendered":"<p class=\"p4\"><span class=\"s2\">The opioid epidemic is one of the worst public health crises affecting the United States, and the rate of deaths resulting from opioid overdose has <a href=\"https:\/\/www.cdc.gov\/nchs\/data\/databriefs\/db329-h.pdf\"><span class=\"s3\">steadily increased<\/span><\/a>. According to the <a href=\"https:\/\/www.cdc.gov\/nchs\/data\/databriefs\/db329-h.pdf\"><span class=\"s3\">Centers for Disease Control and Prevention<\/span><\/a>, a record high of more than 70,000 people died of a drug overdose in the United States in 2017, and over 47,000 of those deaths were from opioid overdoses. As lawmakers attempt to address this epidemic through public health initiatives , health advocates increasingly recommend using <a href=\"http:\/\/www.drugpolicy.org\/issues\/supervised-consumption-services\"><span class=\"s3\">supervised injection sites<\/span><\/a> to curb overdose deaths. Though legal barriers to this in the US exist, a recent District Court ruling in <i>United States v. In these spaces, injection drug users can self-administer drugs they bring to the facility in a <a href=\"https:\/\/nursing.usc.edu\/blog\/supervised-injection-sites\/\"><span class=\"s3\">controlled, sanitary environment<\/span><\/a> under medical supervision. The medical personnel on staff at the sites do not directly handle the drugs and are there purely to administer Naloxone, an overdose reversal drug, in case of an overdose.<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">Despite the growing global presence in Europe, Australia, and Canada, <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pubmed\/25456324\"><span class=\"s4\">scientific support<\/span><\/a> for safe injection sites, and the <a href=\"https:\/\/www.nytimes.com\/2019\/10\/02\/us\/injection-safehouse-philadelphia-ruling.html\"><span class=\"s3\">interest of several cities<\/span><\/a>, including Philadelphia, Boston, New York, Seattle, and San Francisco it is <a href=\"https:\/\/lawdigitalcommons.bc.edu\/%252520bclr\/vol60\/iss2\/2\"><span class=\"s3\">not entirely certain<\/span><\/a> they can be operated in the United States.<span class=\"Apple-converted-space\">\u00a0 <\/span>The Controlled Substances Act <\/span><span class=\"s5\">\u00a7<\/span><span class=\"s2\"> 856, which regulates the production, possession, and distribution of controlled substances, makes it a criminal offense to maintain a drug-involved premises. Most <a href=\"https:\/\/lawdigitalcommons.bc.edu\/cgi\/viewcontent.cgi?article=3737&amp;context=bclr\"><span class=\"s4\">academics<\/span><\/a> agree that this <\/span><span class=\"s5\">\u201c<\/span><span class=\"s2\">Crack House<\/span><span class=\"s5\">\u201d<\/span><span class=\"s2\"> Statute forbids safe injection sites and the courts can not definitively decide if safe injection site violate federal law until one is operational. <\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">However, recently these assumptions have been called into question. Safe injection site proponents in many states have been appealing to legislatures and public health officials for funding.<span class=\"Apple-converted-space\">\u00a0 <\/span>This effort has been <a href=\"https:\/\/www.pewtrusts.org\/en\/research-and-analysis\/blogs\/stateline\/2019\/11\/15\/with-safe-injection-sites-somebody-has-to-go-first-it-could-be-philadelphia\"><span class=\"s4\">largely unsuccessful due to political opposition<\/span><\/a> and the looming threat of a federal lawsuit. In Philadelphia, which has the highest overdose rate of any major US city, a <a href=\"https:\/\/www.pewtrusts.org\/en\/research-and-analysis\/articles\/2019\/05\/01\/crime-drugs-public-safety-are-the-issues-that-matter-most-to-philadelphians-in-2019\"><span class=\"s3\">poll<\/span><\/a> found roughly half of Philadelphians support a proposed safe injection site.<span class=\"Apple-converted-space\">\u00a0 <\/span>Safehouse is a Philadelphia nonprofit that seeks to build the first safe injection site <a href=\"https:\/\/www.thetriangle.org\/opinion\/kensington-needs-a-supervised-injection-site-and-soon\/\"><span class=\"s3\">in the nation<\/span><\/a>. In <a href=\"https:\/\/www.inquirer.com\/philly\/health\/addiction\/safe-injection-site-philadelphia-safehouse-faq-20181008.html\"><span class=\"s3\">January 2018<\/span><\/a>, Philadelphia health officials gave Safehouse permission to move forward with only private funds<\/span><span class=\"s5\">\u2014<\/span><span class=\"s2\">preventing the need for legislative backing and appropriations.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">In February 2019, federal prosecutors <a href=\"https:\/\/www.npr.org\/sections\/health-shots\/2019\/02\/06\/691746907\/u-s-prosecutors-sue-to-stop-nation-s-first-supervised-injection-site\"><span class=\"s3\">launched a civil lawsuit<\/span><\/a> asking the U.S. District Court to rule on the legality of the Safehouse supervised consumption site plan, rather than waiting for the site to be built and then bringing federal criminal charges.<\/span><span class=\"s6\"><sup><span class=\"Apple-converted-space\">\u00a0 <\/span><\/sup><\/span><span class=\"s2\">U.S. Attorney William McSwain, working with Pennsylvania-based prosecutors, is seeking a declaratory judgment that medically supervised consumption sites <i>per se<\/i> violate 21 U.S.C <\/span><span class=\"s5\">\u00a7<\/span><span class=\"s2\"> 856(a)(2)<\/span><span class=\"s5\">\u2014<\/span><span class=\"s2\"> the federal <\/span><span class=\"s5\">\u201c<\/span><span class=\"s2\">Crack House<\/span><span class=\"s5\">\u201d<\/span><span class=\"s2\"> statute.<\/span><\/p>\n<figure id=\"attachment_1232\" aria-describedby=\"caption-attachment-1232\" style=\"width: 511px\" class=\"wp-caption alignleft\"><a href=\"\/dome\/files\/2020\/06\/safehouse-demonstration.jpg\"><img loading=\"lazy\" src=\"\/dome\/files\/2020\/06\/safehouse-demonstration-636x424.jpg\" alt=\"\" width=\"501\" height=\"334\" class=\" wp-image-1232\" srcset=\"https:\/\/sites.bu.edu\/dome\/files\/2020\/06\/safehouse-demonstration-636x424.jpg 636w, https:\/\/sites.bu.edu\/dome\/files\/2020\/06\/safehouse-demonstration-768x512.jpg 768w, https:\/\/sites.bu.edu\/dome\/files\/2020\/06\/safehouse-demonstration.jpg 900w\" sizes=\"(max-width: 501px) 100vw, 501px\" \/><\/a><figcaption id=\"caption-attachment-1232\" class=\"wp-caption-text\">Picture by Holden Blanco<\/figcaption><\/figure>\n<p class=\"p7\"><span class=\"s2\">In February 2020, the court issued <a href=\"https:\/\/www.documentcloud.org\/documents\/6444521-2019-10-02-Memorandum-on-Safehouse.html\"><span class=\"s7\"><i>United States v. Safehouse<\/i><\/span><\/a>, ruling that Safehouse<\/span><span class=\"s5\">\u2019<\/span><span class=\"s2\">s plan to build a site where people could bring previously obtained drugs and use them under medical supervision for the purpose of combating fatal overdoses does not violate the Controlled Substances Act. Judge McHugh, looking at Congressional intent, ruled that <\/span><span class=\"s5\">\u00a7<\/span><span class=\"s2\">856 <\/span><span class=\"s5\">\u201c<\/span><span class=\"s2\">does not prohibit Safehouse<\/span><span class=\"s5\">\u2019<\/span><span class=\"s2\">s proposed medically supervised consumption rooms because Safehouse does not plan to operate them &#8216;for the purpose of<\/span><span class=\"s5\">\u2019<\/span><span class=\"s2\"> unlawful drug use within the meaning of the statute.<\/span><span class=\"s5\">\u201d<\/span><span class=\"s2\"> McHugh determines that at the time of enacting <\/span><span class=\"s5\">\u00a7<\/span><span class=\"s2\">856(a), Congress was focused on crack houses, not supervised drug injection sites. Even when amended in 2003, the focus was on <\/span><span class=\"s5\">\u201c<a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB10364\"><span class=\"s4\">drug-fueled raves<\/span><\/a><\/span><span class=\"s2\">.<\/span><span class=\"s5\">\u201d<\/span><span class=\"s2\"> McHugh found that Congress neither expressly prohibited or authorized injection sites, so if <\/span><span class=\"s5\">\u00a7<\/span><span class=\"s2\">856(a) did not implicitly prohibit a consumption site, then implicit authorization naturally followed.<\/span><\/p>\n<p class=\"p10\"><span class=\"s2\">The question that the court addresses is whether the statute requires the defendant to know that third parties would enter their premises to consume illicit drugs, or rather that the defendant knowingly held their premises open for the <i>purpose<\/i> of facilitating illicit drug consumption. Judge McHugh concludes that the actor must <\/span><span class=\"s5\">\u201c<\/span><span class=\"s2\">have acted for the proscribed purpose<\/span><span class=\"s5\">\u201d<\/span><span class=\"s2\"> to violate the statute.<span class=\"Apple-converted-space\">\u00a0 <\/span>Therefore, the accused under a <\/span><span class=\"s5\">\u00a7<\/span><span class=\"s2\">856(a)(2) violation must have the purpose of facilitating illegal controlled substance use in the maintenance of a property. <\/span><\/p>\n<p class=\"p10\"><span class=\"s2\">Safehouse is planning <\/span><span class=\"s5\">\u201c<a href=\"https:\/\/www.heraldnews.com\/news\/20191003\/federal-judge-rules-for-safe-drug-consumption-sites\"><span class=\"s8\">to make a place available for the purposes of reducing the harm of drug use, administering medical care, encouraging drug treatment, and connecting participants with social service<\/span><\/a><\/span><span class=\"s2\">s.<\/span><span class=\"s5\">\u201d<\/span><span class=\"s2\"> The district court reasons that because of this, it could not conclude that Safehouse has, as a significant purpose, <\/span><span class=\"s5\">\u201c<\/span><span class=\"s2\">the objective of facilitating drug use.<\/span><span class=\"s5\">\u201d<\/span><\/p>\n<p class=\"p12\"><span class=\"s2\">In the wake of the ruling, U.S. Attorney McSwain <a href=\"https:\/\/www.justice.gov\/usao-edpa\/pr\/statement-united-states-attorney-mcswain-today-s-opinion-united-states-v-safehouse\"><span class=\"s9\">announced<\/span><\/a> that <\/span><span class=\"s5\">\u201c<\/span><span class=\"s2\">this case is obviously far from over<\/span><span class=\"s5\">\u201d<\/span><span class=\"s2\"> and it is likely that the federal government will continue to litigate it. It is not unlikely that the Court that may hear this case on appeal disagrees with the District Court\u2019s construction and strikes the legality of a supervised injection site based not on the intent of the person who controls the space, but the intent of the attendee of the site to use illicit drugs at that site, which has been <a href=\"https:\/\/lawdigitalcommons.bc.edu\/cgi\/viewcontent.cgi?article=3737&amp;context=bclr\"><span class=\"s10\">the prevailing opinion up until the point of this ruling<\/span><\/a>.<\/span><\/p>\n<p class=\"p12\"><span class=\"s2\">While the <i>Safehouse<\/i> case stands for an unexpected legal victory by way of the possibility of a supervised injection site to be opened in the United States, Philadelphia itself may not be the first state in the nation to implement one. The public sentiment in the wake of the decision was largely negative, with the<a href=\"https:\/\/whyy.org\/articles\/safehouse-hits-pause-on-plan-to-open-supervised-injection-site-in-south-philly\/\"><span class=\"s10\"> local community being virulently opposed to the idea of a site being opened in the neighborhood<\/span><\/a> from fear of what dangerous circumstances a site might attract. Plans to open the Safehouse site were put on indefinite hold. While proponents of Safehouse won the legal battle, winning over the community seems to be more of uphill battle than anticipated.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">At this point in time, the legal position of supervised injection sites in the United States is tentatively positive. <a href=\"https:\/\/www.nbcbayarea.com\/investigations\/san-francisco-resurrects-plan-to-open-supervised-injection-sites-to-reduce-drug-overdose-deaths\/2247033\/\"><span class=\"s4\">States who are looking to introduce this harm reduction initiative<\/span><\/a>, and to be the first in the nation to do so, should take the opportunity to garner support from legislatures and local health care communities. While Philadelphia<\/span><span class=\"s5\">\u2019<\/span><span class=\"s2\">s progression seems to be stymied, the District Court<\/span><span class=\"s5\">\u2019<\/span><span class=\"s2\">s ruling provides significant legal precedent to ground encouragement for sites to be lobbied for in other states or cities that might not face the same type of community rejection that has prevented the opening of Safehouse.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span class=\"s1\"><a href=\"\/dome\/files\/2020\/05\/Badat_Zahraa_U45393763.jpeg\"><img loading=\"lazy\" src=\"\/dome\/files\/2020\/05\/Badat_Zahraa_U45393763.jpeg\" alt=\"\" width=\"115\" height=\"144\" class=\"wp-image-1102 alignleft\" \/><\/a><strong>Zahra<\/strong><\/span><strong><span class=\"s2\">a Badat <\/span><\/strong><span class=\"s2\">anticipates graduating from Boston University School of Law in May 2021.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The opioid epidemic is one of the worst public health crises affecting the United States, and the rate of deaths resulting from opioid overdose has steadily increased.
