(Photo: Max Schulte\/Rochester Democrat and Chronicle).<\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">Lamb stopped the car after his collision with Moore, but did not give his information to Julian, the paramedics, or Julian\u2019s mother. By the time the police arrived, Lamb had departed the scene. It took <a href=\"https:\/\/abcnews.go.com\/US\/court-ordered-apology-10-year-leaves-family-furious\/story?id=60483458\"><span class=\"s3\">two weeks<\/span><\/a> for the police to track Lamb down and charge him with the misdemeanor crime of leaving the scene of an accident causing personal injury. Pittsford Town Judge John Bernacki had decided to adjourn the case in contemplation of dismissal, meaning Lamb\u2019s record would be wiped clean, on the condition that Lamb write an apology to the boy.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">His apology <a href=\"https:\/\/www.democratandchronicle.com\/story\/news\/local\/columnists\/andreatta\/2019\/01\/16\/oak-hill-golfer-doug-lamb-non-apology-hits-pittsford-boy-julian-moore-hard-hit-and-run-driver\/2588313002\/\"><span class=\"s3\">letter<\/span><\/a> read:<\/span><\/p>\n<p class=\"p1\"><a href=\"\/dome\/files\/2020\/05\/7c058391-22e2-40a8-b7e3-a699fa9b3331-Moore_Letter.jpg\"><img loading=\"lazy\" src=\"\/dome\/files\/2020\/05\/7c058391-22e2-40a8-b7e3-a699fa9b3331-Moore_Letter.jpg\" alt=\"\" width=\"540\" height=\"414\" class=\"size-full wp-image-1091 aligncenter\" \/><\/a><\/p>\n<p class=\"p1\"><span class=\"s1\">This act of \u201ccontrition\u201d drew sweeping public scorn in January after the boy\u2019s mother, Jenny Moore, posted a copy of the letter on her Facebook Page and the backstory subsequently made <a href=\"https:\/\/www.usatoday.com\/story\/news\/2019\/03\/28\/pittsford-bike-crash-doug-lamb-takes-plea-deal-after-apology-rejected\/3304265002\/\"><span class=\"s3\">headlines<\/span><\/a> around the country. In response, <a href=\"https:\/\/www.whec.com\/news\/prosecutors-trial-doug-lamb\/5295627\/?cat=565\"><span class=\"s3\">prosecutors<\/span><\/a> moved to re-open the case and proceed to trial for failing to meet the apology requirement of his plea deal.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Prosecutor <a href=\"https:\/\/www.democratandchronicle.com\/story\/news\/2019\/03\/28\/pittsford-bike-crash-doug-lamb-takes-plea-deal-after-apology-rejected\/3304265002\/?fbclid=IwAR2jW38diiaHMUlsbUws2SDMi25i9HeM_Hbhul5g6CcIERwbj0RKI7PcL5U\"><span class=\"s3\">Daniel Strollo<\/span><\/a> said his office pursued the case to the extent that it did because Lamb neglected to meet the condition to which he agreed to resolve the matter. \u201cMr. Lamb was given one simple instruction: to send a letter of apology,\u201d Strollo said. \u201cHe didn\u2019t do that. When you don\u2019t follow through on the terms of a commitment for a plea or a disposition of a case, our office is not going to just ignore it.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Lamb <a href=\"https:\/\/www.bicycling.com\/news\/a26452913\/non-apology-letter-hearing-postponed\/\"><span class=\"s3\">plead guilty<\/span><\/a> on Dec. 6 in Pittsford Town Court to leaving the scene of an accident causing property damage\u2014a mere traffic infraction. In exchange, Lamb was ordered to pay a $200 fine, perform eight hours of community service. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Julian\u2019s story garnered national attention for his crash. Lamb was protected by a 5,000-pound vehicle of steel. Julian was protected by a plastic helmet. If it seems ludicrous the legal system could enable Lamb to walk away with a small fine and apology, it may be time to even the playing field and shift legislative protections toward vulnerable road users such as Julian. <\/span><\/p>\n<p class=\"p1\"><span class=\"s2\"><b>Vulnerable Road Users<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">All over the country, thousands of similar crashes are occurring in the shadows, without the benefit of a national audience holding drivers accountable.<span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/www-fars.nhtsa.dot.gov\/People\/PeoplePedalcyclists.aspx\"><span class=\"s3\">The National Highway Traffic Safety Administration<\/span><\/a> data shows 857 cyclists were killed in crashes with vehicles the U.S. in 2018.<span class=\"Apple-converted-space\">\u00a0 <\/span>The same study found Florida leading the country with 161 of those fatalities, finding bicycle deaths for those 20 and older have <a href=\"https:\/\/www.jacksonville.com\/news\/20190531\/on-road-biking-deadly-pastime-in-florida\"><span class=\"s3\">tripled<\/span><\/a> since 1975. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">However, Florida legislators are prepared to step up and do something about the mounting problem, formally adopting \u201c<a href=\"https:\/\/www.fdot.gov\/safety\/safety-coalitions\/coalitonsresources.shtm\"><span class=\"s3\">Vision Zero Florida<\/span><\/a>\u201d with a strategic goal of zero traffic fatalities and severe injuries for all users. Part of this vision includes advocacy for a proposed bill, <a href=\"https:\/\/www.myfloridahouse.gov\/Sections\/Documents\/loaddoc.aspx?FileName=_h0455__.docx&amp;DocumentType=Bill&amp;BillNumber=0455&amp;Session=2020\"><span class=\"s3\">H.B. 455 \u2013 Traffic Offenses<\/span><\/a>, in the Florida Legislature which provides criminal penalties for persons committing moving violations causing serious bodily injury or death to a vulnerable road user including: a fine, period of house arrest, mandatory driver education, revocation of driver license. One of the largest shifts however, is the establishment and definition of \u201cvulnerable road user.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The <a href=\"https:\/\/www.bikeleague.org\/\"><span class=\"s3\">League of American Bicyclists<\/span><\/a>, a national bicycle advocacy organization, defines a <a href=\"https:\/\/www.bikeleague.org\/content\/model-vulnerable-road-user-law\"><span class=\"s3\">Vulnerable Road User<\/span><\/a> (\u201cVRU\u201d) as \u201canyone who is on or alongside a roadway without the protective hard covering of a metal automobile. The term includes bicycle riders, pedestrians, motorcyclists, people in wheelchairs, police, first responders, roadway workers and other users like a person on a skateboard or scooter. It is meant to include people who are especially at risk of serious bodily harm if hit by a car, or truck.\u201d<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">VRU laws operate on the principal of general deterrence &#8211; by providing an increased penalty for certain road behaviors that lead to the serious injury or death of certain road users people will be deterred from doing those behaviors around those users.<\/span><\/p>\n<figure id=\"attachment_1095\" aria-describedby=\"caption-attachment-1095\" style=\"width: 304px\" class=\"wp-caption alignleft\"><a href=\"\/dome\/files\/2020\/05\/186571376_28b84ae5aa_z.jpg\"><img loading=\"lazy\" src=\"\/dome\/files\/2020\/05\/186571376_28b84ae5aa_z-477x636.jpg\" alt=\"\" width=\"294\" height=\"393\" class=\" wp-image-1095\" srcset=\"https:\/\/sites.bu.edu\/dome\/files\/2020\/05\/186571376_28b84ae5aa_z-477x636.jpg 477w, https:\/\/sites.bu.edu\/dome\/files\/2020\/05\/186571376_28b84ae5aa_z.jpg 480w\" sizes=\"(max-width: 294px) 100vw, 294px\" \/><\/a><figcaption id=\"caption-attachment-1095\" class=\"wp-caption-text\">Oregon State Capitol<br \/>Salem, 1938<\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">In 2007, Oregon became the first Legislature to pass, <\/span><span class=\"s3\">HB 3314<\/span><span class=\"s1\">, creating an enhanced penalty for careless driving if it contributes to serious physical injury or death to a \u201cvulnerable user of a public way.\u201d Currently, only nine 9 states have laws that define a vulnerable user or VRU and provide particular penalties for actions towards those vulnerable road users or when violations of traffic law lead to the serious injury or death of a VRU\u00a0\u2013 <a href=\"https:\/\/www.cga.ct.gov\/2014\/ACT\/PA\/2014PA-00031-R00SB-00336-PA.htm\"><span class=\"s3\">Connecticut<\/span><\/a>, <a href=\"https:\/\/legis.delaware.gov\/BillDetail\/25723\"><span class=\"s3\">Delaware<\/span><\/a>, <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2019\/71\/ByVersion\"><span class=\"s3\">Florida<\/span><\/a>, <a href=\"https:\/\/www.capitol.hawaii.gov\/session2012\/bills\/HB1666_CD1_.htm\"><span class=\"s3\">Hawaii<\/span><\/a>, <a href=\"https:\/\/www.mainelegislature.org\/legis\/bills\/bills_127th\/billtexts\/SP046601.asp\"><span class=\"s3\">Maine<\/span><\/a>, <a href=\"https:\/\/www.oregonlaws.org\/ors\/801.608\"><span class=\"s3\">Oregon<\/span><\/a>, <a href=\"https:\/\/le.utah.gov\/~2013\/bills\/static\/SB0104.html\"><span class=\"s3\">Utah<\/span><\/a>, <a href=\"https:\/\/vcjtc.vermont.gov\/sites\/vcjtc\/files\/files\/resources\/VT%2520Police%2520Academy%2520training%2520re%2520walk-bike%2520safety.pdf\"><span class=\"s3\">Vermont<\/span><\/a>, and <a href=\"https:\/\/app.leg.wa.gov\/RCW\/default.aspx?cite=46.61.526\"><span class=\"s3\">Washington<\/span><\/a>. In <a href=\"https:\/\/www.bikelaw.com\/2019\/11\/louisianas-vulnerable-road-user-law-is-being-resuscitated\/\"><span class=\"s3\">Texas<\/span><\/a>, approximately 28 cities have passed their own VRU laws in the absence of a statewide version.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">To advance this legislative effort, the League of American Bicyclists, proposes a <a href=\"https:\/\/bikeleague.org\/content\/model-vulnerable-road-user-law\"><span class=\"s3\">model VRU statute<\/span><\/a> for state legislatures. The model language: Section 1) defines VRU protected persons; Section 2) defines when the law is applicable and who can be charged with a violation of the law; Section 3) requires a person charged according to this law to attend a hearing; and Section 4) provides the punishments that are to be given to a person convicted of a violation of this law.<\/span><\/p>\n<p class=\"p1\"><span class=\"s2\"><b>Road Ahead<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Without enhanced protection for VRUs through increased penalties, it is common for a driver who kills or seriously injures a VRU to just be given a ticket for careless driving, as illustrated in a 2013 report by the <a href=\"https:\/\/www.revealnews.org\/article\/bay-area-drivers-who-kill-pedestrians-rarely-face-punishment-analysis-finds\/\"><span class=\"s3\">Center for Investigative Reporting<\/span><\/a> finding that in 238 pedestrian fatalities 60% of motorists found to be at fault or suspected of a crime faced no criminal charges.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As the closing lines of Prosecutor Strollo\u2019s motion on behalf of Julian Moore states, \u201c[t]he people are ready for trial.\u201d Echoing a crystalizing national awareness that calls for increased protections to vulnerable road users, the people are ready for legislative change\u2014and states legislatures should consider adopting a version of the VRU model law to meet this demand.<\/span><\/p>\n<p><span class=\"s1\"><strong><a href=\"\/dome\/files\/2020\/05\/Trobe_Alexandra_U32198917.jpeg\"><img loading=\"lazy\" src=\"\/dome\/files\/2020\/05\/Trobe_Alexandra_U32198917.jpeg\" alt=\"\" width=\"126\" height=\"158\" class=\"wp-image-1107 alignleft\" \/><\/a>Alexandra Trobe<\/strong> anticipates graduating from Boston University School of Law in May 2021.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ten-year-old, Julian Moore was riding his bicycle in a suburb in Rochester, NY on Sept. 7, 2018, when 66-year-old Doug Lamb hit him with his Range Rover.
